Webinar: regulatory compliance for merch in Mexico

A ninety-minute session to understand the NOMs applicable to corporate merch, the CFDI 4.0 invoicing regime, the Carta Porte 3.0 complement, the Federal Law on Personal Data Protection, IMMEX compliance for manufacturers and production ethics. Built for compliance, legal and procurement teams.

Webinar goals

By the end of the session, attendees can identify the NOMs applicable to each merch type, can read a CFDI 4.0 invoice without errors, can validate LFPDPPP compliance in handling personal data, can understand IMMEX compliance for manufacturers and can evaluate supply chain ethical compliance. Attendees receive a thirty-page guide with applicable NOMs, compliance criteria and evidence formats.

The session is capped at forty attendees to keep the conversational format. Questions are answered live during the session. When a question needs extended handling we address it by email after the webinar. Supporting material — guide, templates, examples — is delivered within forty-eight business hours of the session.

Programme: NOMs applicable to merch

The NOMs applicable to corporate merch in Mexico depend on product type. NOM-004-SCFI-2006 regulates labelling of textile, apparel and accessory products. NOM-141-SSA1-SCFI-2012 regulates beverage kits. NOM-024-SCFI-2013 and NOM-003-SCFI-2014 regulate electrical items. NOM-015-SCFI-2003 regulates toy safety. NOM-026-STPS regulates personal protective equipment.

Compliance is validated with the fabric supplier, the accredited certification body and the testing laboratory. Documentation is delivered at programme start and renewed before the anniversary. When a NOM is updated, we adjust compliance within thirty days. Lot-level traceability is kept for three years for audit purposes.

Programme: CFDI 4.0 invoicing

CFDI 4.0 invoicing applies to every merch sale operation in Mexico. The invoice carries issuer and recipient data, lines with VAT breakdown, the payment complement where applicable and the Carta Porte 3.0 complement when transport runs through our logistics network. Issue lead time is within two business days of product delivery.

Invoice cancellation is requested with a declared reason and processed within SAT deadlines. Re-billing is issued the same business day as the request. Integration with SAP, Oracle and NetSuite of enterprise clients enables automatic loading of the CFDI 4.0 invoice into the customer's ERP. Issued invoices traceability is kept for the programme lifetime plus five years.

Programme: LFPDPPP and data handling

The Federal Law on Personal Data Protection in the Possession of Private Parties applies when we handle customer employee data — name, size, shipping address. The workshop operates as data processor and signs the corresponding processing agreement. Data retention is limited to the order duration plus six months. Deletion is executed at the close of the retention period.

Compliance is validated against INAI guidelines. International data transfers require explicit data subject consent and are documented with privacy notice. For clients with tax residence in the European Union, the GDPR additionally applies with a seventy-two-hour breach notification deadline.

Programme: IMMEX compliance

IMMEX compliance applies to manufacturers with a temporary import programme. The workshop operates as sewing or decoration service provider under the applicable regime. The export pedimento is processed when the fabric is imported from Asia. Constancia de situación fiscal and positive opinion on tax compliance are delivered at programme start.

For manufacturers with a robust IMMEX programme, we handle the integration with the customer's foreign trade area. Traceability per imported material is kept with the pedimento and part number. When IMMEX regulation is updated, we adjust compliance within thirty days. CFDI 4.0 invoicing carries the foreign trade complement where applicable.

Programme: supply chain ethics

Supply chain ethics covers four blocks. The first is fair labour — IMSS affiliation, zone minimum wage, no child labour, no forced labour. The second is confidentiality — NDA, sensitive information handling, brand protection. The third is anti-corruption — gifts policy, conflict-of-interest declaration, courtesies register. The fourth is sustainability — textile certifications, recycled materials, waste management.

Ethical compliance is documented with a code of conduct signed by the workshop and by partner workshops. Social audit is run when the customer requests it — for programmes that must comply with Sedex, amfori BSCI or an international brand code. When a partner workshop does not meet the code criteria, we terminate the commercial relationship and reassign the run to a workshop that does.
