Mexico political merch 2026: how to produce without getting tangled with INE, SAT and TEPJF

The 2026 federal and local election cycle in Mexico includes gubernatorial races in 12 states, federal deputies, senators, municipal presidencies and alcaldías in Mexico City. Every candidate, party, coalition and political association needs merch: polos, caps, backpacks, thermos bottles, banners, posters, tarpaulins, wristbands, stickers. The difference between a compliant political merch vendor and a non-compliant one shows up in INE observations, TEPJF fines, SAT rejections and, in the worst case, the cancellation of the candidacy registration.

The five rules that govern political merch in Mexico

Rule one is the electoral-propaganda definition under Article 242 of the Ley General de Instituciones y Procedimientos Electorales (LEGIPE). Electoral propaganda is the set of writings, publications, images, recordings, projections and expressions that political parties, coalitions and candidates broadcast to present their proposals, electoral platform or personal image to the citizenry. Merch falls inside this definition: polos, caps, backpacks, thermos bottles, banners, posters, tarpaulins, wristbands, stickers are electoral propaganda when they carry the name, image, colour or slogan of a candidate or party.

Rule two is the campaign-spend cap. Every candidacy has a campaign-spend cap fixed by INE based on the position and the state. For gubernatorial races in Estado de México, Jalisco, Nuevo León, Guanajuato, Puebla, Querétaro, Veracruz, Chiapas, Coahuila, Hidalgo, Morelos and Tabasco, caps range from 12 million to 60 million MXN depending on the state and the combination. For federal and local deputies the caps are lower. Political merch counts as propaganda spend and must fit the cap.

Rule three is INE fiscalisation. Every piece of electoral propaganda must be registered in the INE Sistema de Fiscalización (SIF) with the vendor's data: RFC, invoice folio, description, quantity, unit price, total amount, delivery date, photographic evidence. Corp-Merch.MX delivers all of this data in SIF-compatible format so the party or candidate can upload the invoice without manual transcription.

Rule four is the personalised-propaganda prohibition. Personalised propaganda for or against candidates is prohibited outside the campaign period under Article 134 of the Constitution and TEPJF jurisprudence. This includes polos, caps, backpacks and other merch that carry a candidate's name or image before the formal start of campaigns. Corp-Merch.MX verifies the state electoral calendar before producing any personalised merch.

Rule five is the minor-expense rule. The INE Reglamento de Fiscalización allows minor expenses to be supported with simplified invoice or ticket when the amount does not exceed a threshold. Corp-Merch.MX invoices with detailed CFDI 4.0 regardless of amount so the party or candidate has complete documentation in the SIF regardless of the expense size.

What kind of merch gets produced in a Mexican election

Polos and shirts are the main volume. For a gubernatorial race with 30 days of campaigning, 30,000 to 80,000 polos are produced depending on the territorial strategy. Corp-Merch.MX produces polos in cotton, cotton-polyester blend and technical dry-fit depending on the state's climate. Sizing segments match the electoral roll: S, M, L, XL, XXL are the most common sizes in central and southern states; northern states skew toward bigger sizes.

Caps are the second volume. A cap is cheaper per unit than a polo and has higher visibility at mass events. Corp-Merch.MX produces trucker caps, baseball caps and visors in cotton, canvas and dry-fit. Colours follow the party or candidate palette, and embroidery is positioned on the front and/or side based on the design.

Backpacks and satchels are handed out at campaign opens and closes. For a gubernatorial race, 5,000 to 15,000 backpacks are produced. Corp-Merch.MX produces backpacks in canvas, 600D polyester and recycled RPET, with embroidered logo on the front and inside pocket for documents.

Thermos bottles, mugs and cylinders are handed out at mass events as recognition to attendees. For events with more than 2,000 people, 3,000 to 10,000 thermos bottles are produced per event. Corp-Merch.MX produces 500 ml, 750 ml and 1 L stainless-steel thermos bottles with laser-engraved logo and, optionally, supporter number for the loyalty programme.

Posters, tarpaulins and banners are fixed and mobile propaganda. Tarpaulins are placed on billboards, pedestrian bridges and private homes. Posters are handed out at rallies and markets. Banners are carried in caravans and concentrations. Corp-Merch.MX produces in digital printing and silkscreen depending on volume.

Proximity merch includes vehicle stickers, fabric wristbands, pins, reusable shopping bags and umbrellas. Corp-Merch.MX recommends that candidates include at least one useful merch piece in their proximity kit so the supporter uses it after the election and the political-personal link is reinforced.

Fiscal compliance of political merch

Requirement one is that the vendor issues CFDI 4.0 with the full fiscal data of the party or candidate. For political parties, the RFC starts with "P" followed by the party code. For candidates, the RFC is their personal RFC as citizens. Corp-Merch.MX stamps with regime 601 for parties and 612 or 621 for candidates depending on their personal fiscal regime.

Requirement two is the detailed description of pieces on the CFDI. The INE SIF requires each CFDI line to include a clear product description, quantity, unit price, total amount and SAT key. Corp-Merch.MX stamps with breakdown by product line, specific SAT key and correct unit of measure.

Requirement three is the payment complement. When the party or candidate pays by wire transfer, Corp-Merch.MX stamps the payment complement with the 20-digit SPEI reference. This closes the fiscal cycle and allows the party or candidate to credit the expense in its SIF accounting.

Requirement four is the ISR retention when applicable. For payments to electoral-propaganda vendors, parties retain ISR when the vendor is an individual and issues an honorarium CFDI. Corp-Merch.MX issues honorarium CFDIs with the correct ISR retention when the client is an individual with business activity and requests an honorarium invoice.

Requirement five is the Carta Porte when applicable. For mass merch deliveries from the Corp-Merch.MX workshop to the campaign warehouse or directly to mass events, Corp-Merch.MX stamps Carta Porte 3.0 with the autotransporte data. This applies to inter-state deliveries or local deliveries with weight or value above the SAT thresholds.

What the political merch vendor must commit to

Corp-Merch.MX commits to five things when we work with parties, coalitions or candidates. First, verify the electoral calendar before producing any personalised merch. Campaign start and end dates vary by state and election type, and producing before the formal start can constitute prohibited personalised propaganda.

Second, deliver SIF-compatible invoicing. Corp-Merch.MX delivers CFDI 4.0 with breakdown by line, SAT key, amount, IVA (when applicable) and fiscal-period reference. For parties, the invoice must be issued within the campaign period for the expense to count toward the relevant cap.

Third, meet agreed production timelines. Electoral campaigns have very tight windows and a production delay can mean the loss of a mass event. Corp-Merch.MX assigns dedicated production capacity for political clients during campaign quarters.

Fourth, do not include third-party propaganda. Polos, caps and other merch must include exclusively the elements approved by the party or candidate: name, image, slogan, colours. Corp-Merch.MX refuses to include elements of two or more parties on the same piece when there is no formal coalition registered with INE.

Fifth, maintain confidentiality about the client and the strategy. Corp-Merch.MX does not communicate to third parties the orders, quantities or destinations of political merch. Confidentiality is contractual and applies to the entire workshop staff, from to on-site delivery.

Typical cases in the Mexican electoral cycle

The most common case is the gubernatorial race. Corp-Merch.MX has produced for gubernatorial races in central and northern states. The typical programme includes 50,000 polos, 20,000 caps, 8,000 backpacks, 6,000 thermos bottles, 3,000 banners and 2,000 tarpaulins for billboards. Production concentrates in the 45 days before the formal campaign start and distributes over the first two weeks through the candidate's territorial structure.

The second most common case is the federal or local deputy race. The typical programme includes 5,000 polos, 2,000 caps, 1,500 thermos bottles and 500 posters. Production concentrates in the 30 days before campaign start.

The third case is the alcaldía or municipal presidency. The typical programme includes 8,000 polos, 3,000 caps, 2,000 backpacks, 1,500 thermos bottles and 1,000 tarpaulins. Production concentrates in the 30 days before campaign start.

The fourth case is the senatorial race. The typical programme includes 12,000 polos, 5,000 caps, 2,500 backpacks and 1,500 thermos bottles, with emphasis on the represented state.

For extraordinary elections outside the federal calendar (vacancies, resignations, death of winner), Corp-Merch.MX produces on shorter timelines with accelerated production and higher unit cost.
