IMMEX 2026 changes: how the maquiladora landscape is rewriting merch programmes

The IMMEX (Industria Manufacturera, Maquiladora y de Servicios de Exportación) regime is entering its most significant operating reform since 2006. The Secretaría de Economía, in coordination with SAT, has confirmed updates that affect IVA acreditamiento, the temporary import control window, the KYC at maquiladora scale and the electronic stamp requirements for cross-border plant merch. At Corp-Merch.MX we operate the production line for plant merch for clients across Baja California, Sonora, Chihuahua, Coahuila, Nuevo León, Tamaulipas, Jalisco, Guanajuato and Puebla, and we are already seeing the early impacts in the 2026 order books.

What is actually changing in IMMEX for 2026

Change one is the IVA acreditamiento tightening. SAT has clarified that 16 % IVA paid on domestic merch delivered to a maquiladora plant is fully creditable against the maquiladora's own IVA generated by its export operations, but only when the CFDI carries the precise SAT product keys, the plant's fiscal zip code (not the corporate office zip) and the receptor's tax regime as 601 (Régimen General) or 626 (RESICO) as applicable. Maquiladoras that historically accepted generic "uniforms" or "gifts" keys from merch vendors are now seeing rejections during the monthly IVA filing.

Change two is the temporary import control window. The previous 18-month window for temporarily imported inputs has been redefined to a 12-month operational window with one extension of 6 months, conditional on an active export folio. Maquiladoras that fail to export within the window lose the temporary-import benefit and the merch delivered at the plant — even when entirely domestic — sits under closer SAT scrutiny. Corp-Merch.MX coordinates with the client's customs broker so that domestic merch stays cleanly outside the temporary-import flow.

Change three is KYC at maquiladora scale. The Unidad de Inteligencia Financiera (UIF) and SAT have aligned the KYC requirements for plant vendors with the requirements for financial institutions. Maquiladoras must now keep on file a copy of the merch vendor's Constancia de Situación Fiscal (under 30 days old), opinion 32-D positive, evidence of fiscal address, bank-account confirmation with CLABE, articles of incorporation and legal representative ID. Corp-Merch.MX delivers the full KYC pack within 48 hours of contract signature.

Change four is the cross-border electronic stamp for plant merch delivered in the US side of a maquiladora operation. The CFDI 4.0 carries the foreign-trade complement with pedimento data, 0 % IVA when the service is rendered abroad, and the customs broker's folio. Corp-Merch.MX stamps this CFDI in coordination with the maquiladora's broker so that the merchandise crosses without observation.

Change five is the plant-level environmental and labour compliance review. The new IMMEX 2026 framework includes a labour-rights module that reviews the maquiladora's record on gender equity, freedom of association and occupational safety. Maquiladoras with active merch programmes that include recognition of female plant workers, lactation rooms, ergonomic gear and inclusive sizing score better in the review. Corp-Merch.MX's plant merch brief already covers these dimensions.

How this changes the merch programme for plants

The merch programme for a maquiladora plant has traditionally been designed around three pillars: uniform roll-out, anniversary recognition and seasonal gifts. The 2026 changes push the brief towards five pillars that align better with the new compliance framework.

Pillar one is the induction kit. Every new hire receives a kit with the items needed for the first 30 days: technical apparel, hydration, identity badge, and onboarding documentation. Corp-Merch.MX produces induction kits on a weekly cadence based on the plant's hiring plan. The KYC review now requires Corp-Merch.MX to confirm the destination of every induction kit is a current employee, not a contractor or third-party worker.

Pillar two is the anniversary recognition. Maquiladoras with high retention rates (above 80 % at the 1-year mark, above 60 % at the 5-year mark) tend to invest more in anniversary merch. The 5-year, 10-year and 15-year milestones are the ones that drive retention. Corp-Merch.MX produces anniversary merch with the personalisation (name, plant, years of service) and the IVA treatment for gifting to employees as part of the labour benefits.

Pillar three is the skills and certification recognition. As maquiladora's shift to industry 4.0, technical certifications (SPC, Six Sigma, IPC, automation, robotics) become central to the worker's progression. Corp-Merch.MX produces tech-recognition kits with apparel and accessories that mark the certification and that the worker uses during their certified tenure.

Pillar four is the maternity and family pillar. Female plant workers — who now make up between 35 % and 60 % of the maquiladora workforce depending on the cluster — appreciate a maternity kit that reaches them at home during their leave. Corp-Merch.MX produces and ships the maternity kit to the worker's home address, with the personalisation and the LFPDPPP-compliant handling of personal data.

Pillar five is the well-being and engagement pillar. Pause-active equipment (yoga mats, meditation cushions, hydration bottles with daily tracking), recognition for team achievements, and seasonal merch that the worker uses outside the plant (jackets for cold commutes, umbrellas for rainy seasons, water bottles for the family). Corp-Merch.MX designs this pillar with the plant's HR lead to align with the engagement surveys.

The maquiladora's merch programme as a tax artefact

Each merch programme is now a tax artefact that SAT can review. The dossier the maquiladora keeps for audit includes: master agreement with the merch vendor, KYC pack of the vendor, CFDI 4.0 with the precise SAT keys and the plant's fiscal zip code, payment complement with the SPEI reference, Carta Porte when applicable, donor complement when the merch goes through a non-profit (D01 use-of-CFDI), foreign-trade complement when the merch crosses the border, evidence of delivery to current employees only, and annual fiscal report with the breakdown by product line and cost centre.

Corp-Merch.MX delivers this dossier to the maquiladora's finance team at the close of every quarter. The dossier comes as a PDF packet with the relevant XML files, a control spreadsheet and a brief memo on the items SAT has flagged as observation-worthy in past reviews (the most common ones being wrong SAT keys, wrong fiscal zip, missing payment complement, and Carta Porte below the threshold).

For maquiladoras under RESICO (typically smaller operations with annual revenue under MXN $35 million), the merch programme follows the same rules but the ISR rate is preferential. The CFDI still carries regime 626 on the receptor side, and the merch vendor still applies 16 % IVA with the corresponding acreditamiento for the maquiladora. Corp-Merch.MX advises on the optimal receptor-regime coding per CFDI.

What to plan for in the next 12 months

The next 12 months will see three operational rollouts. The first is the IVA filing under the new keys. Maquiladoras should run a sample of their Q4 2025 merch invoices through a SAT portal validation tool to confirm the keys and the receptor data are correct before the January 2026 monthly filing. Corp-Merch.MX provides this validation free of charge for active clients.

The second rollout is the KYC pack refresh. Maquiladoras that have not refreshed their merch vendor's KYC pack in the last 12 months should request a refresh now. Corp-Merch.MX delivers the refreshed pack within 48 hours, including the new Constancia de Situación Fiscal, the positive 32-D opinion and the bank-account confirmation with the current CLABE.

The third rollout is the labour-rights compliance review. Maquiladoras that have not documented the merch programme's contribution to gender equity, freedom of association and occupational safety should start the documentation now. Corp-Merch.MX supports with templates and a memo on how the merch programme supports each of the three modules.

For maquiladoras planning to open new plants in 2026 (clusters of Saltillo, Silao, San Luis Potosí, Apodaca, Ciudad Juárez are seeing active expansion), the merch programme should be designed before the plant opens. Corp-Merch.MX helps with the merch brief for the opening team, the induction kits for the first 100 hires, and the anniversary kits for the workers transferring from other plants. The opening merch programme becomes the worker's first impression of the new plant and Corp-Merch.MX treats it accordingly.

Let's scope your IMMEX 2026 merch programme

If your plant is entering the new IMMEX 2026 framework or if you are opening new plant capacity, let's talk. We need the legal name of the maquiladora, RFC, plant location, headcount, current merch programme, and brief for the 2026 plan. We will quote with the KYC pack, the fiscal calendar, the production timeline and the cross-border logistics where applicable.
