Branded merch and foundations: how in-kind donations amplify social impact in Mexico
Corporate and CSO foundations in Mexico receive thousands of tonnes of corporate merch in donation every year: polos for fundraising sports events, thermoses for athletic runs, notebooks for education programmes, hygiene kits for shelters, backpacks for children in rural areas. In-kind donation is protected by Article 27 of the LISR (Income Tax Law) and, when correctly documented, generates a tax deduction for the donor. Corp-Merch.MX works with corporate foundations of Grupo Bimbo, FEMSA, BBVA, Cinépolis and hundreds of CSOs in Mexico City, Guadalajara, Monterrey, Oaxaca and Chiapas.
Why donated merch operates differently from commercial merch
Merch destined for foundations and CSOs is governed by five operational constraints that commercial merch does not always share. The first is documentary traceability: the donor must deliver to the CSO a donation CFDI with the corresponding complement, identify the market value of the pieces and obtain the deductible donation receipt. The second is the validity of the pieces: donated merch must be delivered with at least 12 months of remaining useful life and without logos of concluded campaigns that confuse the beneficiary.
Corp-Merch.MX has coordinated merch donations for foundations such as Fundacion Bimbo, Fundacion FEMSA, Fundacion BBVA Mexico, Fundacion Cinépolis, Fundacion Telmex-Telcel, Fundacion Carlos Slim, Fundacion Azteca, Fundacion C&A, Fundacion Walmart, Fundacion Soriana, Fundacion Gigante, and CSOs such as Fundacion Merced, Fondo para la Paz, Educa Mexico, Save the Children Mexico, Aldeas Infantiles SOS Mexico, Un Kilo de Ayuda, Fundacion Vamos and many more. The operation is always the same: identification of donable pieces, fiscal valuation, logistics coordination and documentary traceability.
Article 27 of the Ley del Impuesto sobre la Renta (LISR, Income Tax Law) allows the deduction of in-kind donations to authorised CSOs, provided the CSO delivers a deductible donation receipt that meets SAT requirements (folio, date, donor RFC, CSO RFC, description of goods, estimated value of goods, deductibility legend). The CFDI that supports the donation must be issued with the corresponding product key and the donoratarias complement when applicable. Corp-Merch.MX stamps the donation CFDI and delivers to the donor the complete documentation for their accounting.
Merch donation is frequently combined with cause-merch programmes (cause-related marketing): the client sells polos or thermoses at commercial price, donates a portion of the price to a foundation, and reports the environmental or social impact. Corp-Merch.MX has coordinated this type of programme for clients funding reforestation, beach cleanup, literacy or child nutrition projects — donation traceability is linked to the sales campaign and reported quarterly to the client's sustainability and communications areas.
The merch donation budget varies enormously. A small foundation can receive a donation valued at MXN $20,000 per year; a corporate foundation at large corporates can receive between MXN $500,000 and MXN $5,000,000 in donated merch per year. Corp-Merch.MX works with both profiles and adapts its operation: for small CSOs we deliver directly to their address in Mexico City, Guadalajara or Monterrey; for corporate foundations we handle consolidated batches with Carta Porte 3.0 and delivery to the foundation's central warehouse.
Four-step checklist for donating merch with correct tax deduction
1. Identify donable pieces with remaining useful life
Step one is to inventory the pieces the company has in storage and that are in condition to be donated: polos in current sizes, thermoses without pending technical issues, backpacks in original packaging, notebooks without sensitive personalisation, electronics in sealed packaging. Corp-Merch.MX helps the client evaluate the inventory, separate pieces with sufficient useful life (minimum 12 months) and discard pieces with logos of concluded campaigns or defects that make them unusable.
2. Value the pieces at market value and document the donation
Step two is to value the pieces at market value (not at production cost) and issue the donation CFDI with the corresponding complement. Corp-Merch.MX stamps the CFDI with the SAT product key, quantity, unit value at market price, and the deductible donation legend. The CSO issues the donation receipt with folio and donor data, in accordance with SAT requirements for authorised donoratarias.
3. Coordinate logistics with the receiving foundation
Step three is to coordinate logistics with the receiving foundation or CSO. Corp-Merch.MX delivers to the donor and the foundation a delivery plan with Carta Porte 3.0 when the shipment exceeds 1.5 tonnes or MXN $50,000, collection date, warehouse address, receiving contact and photographic evidence. For small CSOs, Corp-Merch.MX delivers to the organisation's address; for corporate foundations, delivery goes to the central warehouse.
4. Report the donation impact to the sustainability area
Step four is reporting the impact. Corp-Merch.MX delivers to the donor a quarterly report with donated pieces, market value, receiving foundation, delivery date, photographic evidence and impact metrics when the foundation reports them (number of beneficiaries, communities served, events held with the pieces). This report feeds the client's ASG / ESG sustainability report and the GRI and SASB indicators that apply to their sector.
What Corp-Merch.MX delivers in every merch donation programme
For clients launching an in-kind donation programme, Corp-Merch.MX delivers donable inventory evaluation, fiscal valuation at market value, donation CFDI stamping with complement, logistics coordination with the receiving foundation, delivery plan with Carta Porte 3.0 when applicable, quarterly impact report, and documentation ready to file with SAT and the authorised donataria. The minimum operation is 100 donated pieces for the administrative cost of the donation to be justified.
If your foundation, sustainability area, communications or corporate social responsibility is evaluating an in-kind donation programme, let us talk. We need available inventory, receiving foundation or CSO, target delivery dates and the donor's tax regime. From there we issue valuation, donation CFDI, delivery plan and Carta Porte when applicable.
Frequently asked questions about merch and foundations
What SAT requirements must the donation CFDI meet?
The donation CFDI must be issued with the SAT product key, unit value at market price, quantity, donor and CSO data, and the donoratarias complement when applicable. The CSO must be authorised by SAT as a donataria and deliver to the donor a deductible donation receipt with folio, date, description of goods, estimated value and deductibility legend in accordance with Article 27 of the LISR.
Which pieces should not be donated to foundations?
Corp-Merch.MX recommends not donating pieces with logos of concluded campaigns, with discontinued sizes, with factory defects, with electronics without original packaging, or with beverages, perishable food or medication. Pieces with symbolic unit value that create confusion in the fiscal valuation are also not donated. The donated piece must be functional and current.
How is donation impact reported in the ESG report?
Corp-Merch.MX delivers to the donor a quarterly report with donated pieces, market value, receiving foundation, delivery date, photographic evidence and, when the foundation reports them, impact metrics (number of beneficiaries, communities served, events held). The report feeds the client's GRI and SASB indicators and is incorporated into the annual ASG / ESG sustainability report.
