United States Corporate Event 2026: the most sensitive operation to USD invoice, W-8BEN-E, recipient EIN, state sales tax, and gifts where the US delegate accepts Tennessee whiskey over Mexican tequila

The corporate event in the United States runs under different fiscal rules than Mexico. The invoice is issued as a USD invoice, not as electronic invoice, with the EIN (Employer Identification Number) of the partner-emitter and, when the recipient is a Mexican tax resident, withholding on payments abroad via Form W-8BEN-E (entities) or W-8BEN (individuals). The operation from a Mexican base toward the US client runs with two simultaneous fiscal flows: the coordination component is invoiced from Mexico as CFDI 4.0 SAT with 16% IVA, and the US local component is invoiced with a USD invoice with EIN and, when applicable, state sales tax (0% to 10% varying by state: Texas 0%, Florida 6%, New York 4.5% state + 0.375% MTA + up to 4.875% local, California 7.25% base + up to 3% local). The language is 100% English for printed material, invitations, and signage. The gift curation adapts to the delegate profile: Kentucky bourbon, Tennessee rye whiskey, Vermont artisan cheese, Pacific Northwest smoked salmon, author sweets, Brooklyn specialty coffee, Napa Valley wine.

W-8BEN-E, EIN, state sales tax, and cross-border deduction

Form W-8BEN-E is the certificate of foreign status for non-US entities that receive payments of US source. It is filed by the US partner with the payer (the Mexican client) to certify that it is a US tax resident and that the payments qualify under the Mexico–US DTA in force since 1993 with 2002 amending protocol. The partner withholds US ISR on the payment abroad only if the operation qualifies as ECI (Effectively Connected Income) or if the recipient does not file a valid W-8BEN-E. For the Mexican client, the US component is deducted as expense under Article 5 of the LISR and ISR is withheld when the partner does not file the certificate.

The EIN (Employer Identification Number) is the US fiscal identifier of the partner, equivalent to the Mexican RFC. It is issued by the IRS (Internal Revenue Service). State sales tax is an indirect tax on sale of tangible goods and services, collected by the state and, in some cases, by municipalities (county, city). The rate varies from 0% (Alaska, Delaware, Montana, New Hampshire, Oregon) to 10% (Louisiana with surtaxes). For tangible gifts the state rate of the delivery address applies. For consulting, design, and coordination services most states do not charge sales tax.

For the Mexico-based client, the deduction operates with the mirror invoice of the US component (USD invoice) plus the CFDI 4.0 SAT of the Mexican component. The client deducts as expense the US proportion if the event ties to the Mexican operation, withholds ISR on payments abroad (except if partner files valid W-8BEN-E with DTA reduced rate), and applies 100% creditable IVA on the Mexican component with CFDI 4.0. For IMMEX with border plant, the US event ties to manufacturing-export promotion and deducts under specific treatment.
